These Terms of Service ("Terms") are an agreement between you and Blue Collar Labs Inc., a British Columbia corporation doing business as Dakota Prep ("Dakota Prep," "we," "us"). They apply to every product and service we offer, including:
Together these are the "Services." By creating an account, purchasing a subscription or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
If you use the Services through an account provided by a school, college, apprenticeship or training program, trade association, union, contractor or employer (an "Institution"), the Institution's agreement with us may also apply, and where that agreement conflicts with these Terms, the Institution's agreement controls for that account.
You must be at least 13 years old to use the Services. If you are under 18, you confirm that a parent, guardian or Institution has reviewed these Terms and permits your use. We do not knowingly allow children under 13 to create accounts.
You must not use the Services if you are barred from doing so under the laws of the country where you live.
You need an account for most features. When you create one you agree to:
You are responsible for all activity under your account. One person may hold one account. Institutions may create and manage accounts for their learners through the instructor portal; those accounts remain subject to these Terms.
Free and paid features. Parts of the Services are free. Others require a one-time purchase or a subscription. Prices and what each plan includes are shown at the point of purchase and may change for future billing periods with notice.
How you pay. Purchases are processed by Apple (App Store), Google (Google Play) or Stripe, depending on where you buy. We do not store your full card number. Each payment processor has its own terms, and purchases made through Apple or Google are also governed by that store's rules.
Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. You can cancel at any time:
Cancelling stops future charges. You keep access until the end of the period you have already paid for.
Free trials. We do not currently offer free trials. If we introduce one, its length and terms will be shown before you start, and you will be charged for the first billing period when the trial ends unless you cancel before then.
Refunds. All purchases are final and non-refundable, except where a refund is required by law. Purchases made through Apple or Google are subject to that store's refund policy, which we do not control. If you believe you were charged in error, contact support@dakotaprep.com.
Institutional licenses. Seat licenses purchased by an Institution are governed by the order form or agreement between us and the Institution, including pricing, term and renewal.
Taxes. Prices may exclude sales tax, GST/HST or similar taxes, which are added where required.
We grant you a limited, personal, non-exclusive, non-transferable license to use the Services for your own study, training or teaching. You may not:
The Services and everything in them — question banks, explanations, simulators, software, designs, text, video and the Dakota Prep and Dakota Labs names and logos — belong to Blue Collar Labs Inc. or our licensors and are protected by copyright, trademark and other laws. Nothing in these Terms transfers any of those rights to you.
NFPA, National Electrical Code, NEC, Red Seal, IBEW and other names of codes, exams and organizations referenced in the Services are trademarks of their respective owners. We are not affiliated with, endorsed by or sponsored by any of them.
Our content is created by licensed tradespeople and instructors and we work to keep it accurate and current, but:
You may post questions, comments, lab configurations or other material in our communities or tools ("Your Content"). You keep ownership of Your Content. You grant us a worldwide, royalty-free license to host, display, reproduce and adapt it as needed to run and improve the Services. You are responsible for what you post and confirm you have the right to post it.
We may remove Your Content that violates these Terms or that we reasonably believe is harmful, infringing or unlawful.
We are committed to a safe and respectful environment for learners and our staff. You agree not to engage in behavior that is abusive, harassing, hateful or discriminatory, including remarks about race, gender, religion, sexual orientation or other protected characteristics. This applies in the apps, in support conversations and in any community we operate, including Discord. We may suspend or terminate accounts that violate these standards, with or without refund.
If you are an instructor or administrator using the instructor portal or Dakota Labs on behalf of an Institution:
Learner Data does not include our content, de-identified or aggregated data we derive from it (such as performance statistics used to improve and benchmark the Services), or data in a learner's own separate account. A learner who also creates a personal account with us is a direct customer for that account, and these Terms and our Privacy Policy govern it.
Results, credentials and certificates a learner earns belong to the learner. With the learner's consent, a learner may keep a copy of their own results and credentials in a personal account, which continues after the Institution's agreement ends. An Institution may ask us to disable this for its learners.
Institutions requiring a data processing agreement, FERPA addendum or similar terms should contact support@dakotaprep.com.
The Services rely on third-party providers, including Apple, Google, Stripe, RevenueCat, PostHog, Sentry, Discord and Webflow, each with its own terms. We are not responsible for third-party services, and links to outside websites do not mean we endorse them.
Some features need an internet connection. You are responsible for your device, your connection and any data or roaming charges.
We may add, change or remove features, and may discontinue a product, at any time. Where practical we will give notice of material changes.
You may stop using the Services and delete your account at any time from your account settings or by emailing support@dakotaprep.com. We may suspend or terminate your access if you violate these Terms, fail to pay, or if we reasonably believe your use creates risk for us or other users. Sections 6, 7, 13, 14, 15 and 16 survive termination.
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or secure, or that content will be complete or current.
Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
To the fullest extent permitted by law:
These limits apply whether the claim is in contract, tort, negligence or otherwise. Some jurisdictions do not allow these limits, so they may not apply to you in full. Nothing in these Terms limits liability that cannot be limited by law.
You agree to defend and indemnify Blue Collar Labs Inc. against claims, losses and reasonable legal fees arising from Your Content, your violation of these Terms, or your misuse of the Services.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be brought exclusively in the courts of British Columbia sitting in Vancouver, and you consent to their jurisdiction.
Before filing any claim, you agree to contact us at support@dakotaprep.com and give us 30 days to try to resolve it.
Nothing in this section removes consumer rights you have under the laws of the US state or Canadian province where you live that cannot be waived by contract.
We may update these Terms from time to time. Updated Terms take effect when posted at dakotaprep.com/terms-conditions, and continuing to use the Services after that means you accept them. We recommend reviewing this page periodically.
These Terms, together with the Privacy Policy and any Institution agreement, are the entire agreement between you and us about the Services. If any provision is unenforceable, the rest remains in effect. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. Our failure to enforce a provision is not a waiver.
