1. Who we are and what this covers

Blue Collar Labs Inc., doing business as Dakota Prep ("we," "us"), is the controller of personal information collected through the Services described in our Terms of Service: the dakotaprep.com website, our mobile and desktop apps, our web exam prep and training platforms including Dakota Labs, the instructor portal, and our online communities.

This policy explains what we collect, why, who we share it with, how long we keep it and the choices you have. Capitalized terms have the meaning given in the Terms of Service.

Where an Institution provides your account, we process learner data on the Institution's behalf and under its instructions in addition to this policy. Questions about how your Institution uses your data should go to the Institution.

2. Information we collect

Information you give us

  • Account details: name, email address, and optional profile details such as trade, state or province, license type and exam date. We do not use passwords; you sign in with a one-time code sent to your email.
  • Purchase details: the plan you bought and billing history. Card numbers are collected and stored by Stripe, Apple or Google, not by us.
  • Content you create: community posts, support messages, lab configurations and anything else you submit.
  • Institution details: for educator accounts, your Institution, role and the learners you enroll.

Information collected automatically

  • Learning activity: questions answered, scores, time spent, courses and labs completed, hours logged, and similar progress data.
  • Device and usage data: device type, operating system, app version, IP address, browser, pages viewed, features used, crash and error logs.
  • Cookies and similar technologies on our website and web apps (see section 5).

Information from others

  • From Apple, Google and Stripe: confirmation of purchases, subscription status and refunds.
  • From an Institution: your name, email and enrollment when it creates your account.
  • From Discord, if you join our community server: your Discord username and public profile.

We do not collect government ID numbers, precise location, biometric data or health information, and we do not sell personal information.

3. How we use information

  • To provide the Services: create and secure your account, deliver content, save your progress, run simulators, process payments and provide support.
  • To improve the Services: analyze which questions, features and courses work, fix bugs and develop new products.
  • To communicate: send receipts, account notices, security alerts and, with your consent or where permitted, product updates and promotional emails you can opt out of at any time.
  • For Institutions: give instructors reports on their learners' progress.
  • To protect us and others: detect fraud, enforce our Terms and comply with law.

Where a legal basis is required, we rely on performance of our contract with you, our legitimate interests in running and improving the Services, your consent (for marketing and non-essential cookies) and compliance with legal obligations.

4. How we share information

We share personal information only as follows:

  • Service providers who process data for us under contract and only on our instructions, including hosting and infrastructure, Stripe (payments), RevenueCat (subscription management), PostHog (product analytics), Sentry (error reporting), Firebase (analytics and crash reporting), email delivery and customer-support tools, and Webflow (website hosting).
  • App stores: Apple and Google receive what is needed to complete in-app purchases.
  • Your Institution: if your account is provided by a school, apprenticeship program or employer, its instructors and administrators can see your enrollment, progress and scores.
  • Communities: anything you post in Discord or other community spaces is visible to other members.
  • Legal and safety: when required by law, to respond to lawful requests, or to protect the rights, safety and property of Dakota Prep, our users or others.
  • Business transfers: in connection with a merger, acquisition, financing or sale of assets, with notice to you.

We do not sell personal information.

5. Cookies and analytics

Our website and web apps use cookies and similar technologies for three purposes: keeping you signed in and the site working (essential), understanding how the site and apps are used (analytics, via PostHog and Google Analytics for Firebase), and, on the website, measuring marketing campaigns. Our mobile apps use device identifiers and SDKs for the same analytics and crash-reporting purposes.

You can control or block cookies in your browser settings. Turning off essential cookies may prevent parts of the Services from working.

6. How long we keep information

  • Account, learning and usage data: for up to 7 years after your last activity, or sooner if you delete your account. When you delete your account we remove or anonymize your personal information within 30 days, except records we must keep for the periods below.
  • Billing and tax records: 7 years, as required by tax and accounting law.
  • Institution learner data: for the term of the Institution's agreement with us, then deleted or returned under that agreement.
  • Support messages and community posts: until you delete them or your account is deleted, except where needed to resolve a dispute or comply with law.

7. Your choices and rights

Everyone can:

  • update account details in settings;
  • opt out of marketing emails using the unsubscribe link in any message, or by emailing us (you will still receive transactional messages such as receipts);
  • delete your account from your account settings in the app or website, or by emailing support@dakotaprep.com; we will confirm deletion within 30 days;
  • request a copy of the personal information we hold about you.

If you live in California (or another US state with a comprehensive privacy law), you have the right to know what personal information we collect, use and disclose; to access, correct and delete it; to opt out of sale or sharing for targeted advertising (we do neither); and not to be discriminated against for exercising these rights. You may use an authorized agent.

If you live in Canada, you have the right under PIPEDA and applicable provincial law to access and correct your personal information and to withdraw consent, subject to legal and contractual limits. Our designated privacy contact is Alex, Chief Executive Officer, reachable at support@dakotaprep.com. You may complain to the Office of the Privacy Commissioner of Canada or your provincial commissioner.

If you access the Services through an Institution, send access and deletion requests to the Institution; we will assist it in responding.

To exercise any right, email support@dakotaprep.com from the address on your account. We may ask for information to verify your identity.

8. Security

We use commercially reasonable administrative, technical and physical safeguards, including encryption in transit, passwordless sign-in with one-time codes, access controls and vetted service providers. No system is completely secure. If a breach affects your personal information, we will notify you and the relevant authorities as the law requires.

9. Children

The Services are not directed to children under 13, and we do not knowingly collect personal information from them. Learners aged 13 to 17 may use the Services with the permission of a parent, guardian or Institution. If you believe a child under 13 has given us personal information, email support@dakotaprep.com and we will delete it.

10. International transfers

We are a Canadian company with operations in the United States, and our service providers store data primarily in the United States. If you are in Canada or elsewhere, your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country. We use contractual and technical safeguards to protect it.

11. Changes to this policy

We may update this policy from time to time. Updates take effect when posted at dakotaprep.com/privacy-policy. We recommend reviewing this page periodically.
