TOURNAMENT WAIVER OF LIABILITY

IN CONSIDERATION of being included in the above mentioned Dakota Prep Tournament, the undersigned as coach and the legal guardians of the listed players hereby agree that the coach and players assume all risks in connection with use of the facilities ("premesis"), and further waive all claims for recovery and release Dakota Prep, LLC, its employees, officers and directors, from liability for any loss or damage to their person or property, whether foreseen or unforeseen, and whether directly or indirectly resulting from the competition, the premises or the conduct of the tournament. This waiver includes, but is not limited to, claims arising from: |

a) any theft or loss of any item of personal property brought onto the facility's premises, or any damage to the same; |
| |
b) any personal injury occurring while present on the facility's premesis; |
| |
c) any peronal injury or property damage resulting from the acts or omissions or property in control of Dakota Prep, LLC, its employees, or its agents; |
| |
d) any personal injury or property damage occurring during the time of or arising out of transportation to and from the tournament; |
| |
e) any personal injury or property damage resulting from items or products owned by Dakota Prep, LLC, or brought by one of its employees or agents to the tournament; and |
| |
f) any personal injury or property damage arising from persons or circumstances oustide of and beyond Dakota Prep, LCC's, control. |
| This Waiver shall also be binding upon family, heirs, legal representatives, and assigns |
| We have read all the terms of this instrument and understand that I am signing a complete release and bar to any claim resulting from the tournament hosted by Dakota Prep, LLC. |
